IP Enforcement
IP Enforcement in Ukraine
A registered right is only as good as your ability to act on it. We stop infringement before it reaches court where we can, and represent you in court where we must.
Four Ways to Protect Your Rights
Chosen to fit the dispute, not applied as a single default playbook
-
Non-Jurisdictional Route
A cease-and-desist letter and negotiation with the infringing party. Lower cost and often faster, though it depends on the other side engaging in good faith.
-
Jurisdictional Route
Ukrainian law does not require pre-litigation settlement before filing suit — once your rights are documented, you can go straight to court.
-
Customs Recordal
Trademarks, patents and copyright works entered on the Customs Register of Intellectual Property are checked automatically against goods crossing the border.
-
Online Infringement
Under Ukraine’s Code of Administrative Offences (Art. 164-17, 164-18), posting infringing content online carries liability even for a minor. A single notice to the platform is often enough to have it removed.
Customs Register Protection
Stop counterfeit goods at the Ukrainian border before they reach the market
- 1
Submit Rights Documentation
Certificate or patent number and exact name, registration and expiry dates, and owner details are prepared for entry onto the register.
- 2
Recordal Confirmed
The object is entered on the Customs Register of Intellectual Property with its registration and expiry dates recorded down to the second.
- 3
Automatic Border Monitoring
The record is shared automatically with every customs and fiscal authority in Ukraine, at every border crossing.
- 4
Suspected Infringement Held
Clearance of matching goods is suspended — up to 10 working days, or 3 working days for perishable goods with no extension — and you are notified by fax or email.
Pre-Litigation & Court Enforcement
Imitation by a competitor is often a sign of success — but it still needs to be stopped. Which route makes sense depends on the facts, the paperwork you hold, and how the other side responds.
- No mandatory pre-litigation step under Ukrainian law — you can file suit directly
- Documentary proof of ownership is the starting point: a certificate, patent or licence agreement
- A registration left unused in Ukraine for a long period can be cancelled for non-use — the basis of our results against Philip Morris and Lorillard
- Evidence gathering, pleadings and representation handled by advocates, not general commercial lawyers
Governing Law
Enforcement in Ukraine draws on several statutes, applied together depending on the right at stake
- Law of Ukraine "On Copyright and Related Rights"
- Law of Ukraine "On the Protection of Rights to Inventions and Utility Models"
- Law of Ukraine "On the Protection of Rights to Industrial Designs"
- Law of Ukraine "On the Protection of Rights to Marks for Goods and Services"
- Protection against unfair competition
