PCT National Phase Entry in Ukraine: A Checklist
The 31-month deadline, what UANIPIO needs to open the file, the current official fees in hryvnia, and the points that catch foreign firms out when entering the Ukrainian national phase.
Entering the Ukrainian national phase is procedurally straightforward once a file is open — the mistakes that cost time almost all happen before that point. This is the checklist we actually work from.
The deadline
31 months from the priority date — that is, from the earliest priority date claimed, not from the international filing date. Where no priority is claimed, the two are the same; where they differ, count from the earlier one.
We recommend instructing us at least 2 months before the deadline. Translation and formalities take time, and a deadline like this is not the place to discover a missing document in the last week.
What UANIPIO needs to open the file
- The international application number or PCT publication number
- Applicant and inventor details, exactly as they should appear on the Ukrainian filing
- Any amendments made under PCT Article 19 or 34 that should carry into the national phase
- The Ukrainian translation of the application (see below)
- A power of attorney in favour of a Ukrainian patent attorney (see below)
Representation and power of attorney
A non-resident applicant must act through a registered Ukrainian patent attorney, and the Office requires a power of attorney for that appointment. The WIPO PCT Applicant’s Guide reproduces a model form for Ukraine; we send the form we need with our acknowledgement of instructions.
If the power of attorney is not on file by the 31-month date, that does not by itself lose the filing: the Office invites the applicant to furnish it within 2 months of the invitation. In practice we file on time with whatever is ready and complete the formalities afterwards.
We will confirm the exact signature and form requirements for your applicant when you instruct us — they depend on who signs and in what capacity.
Translation
The application is filed in Ukrainian. The description, claims, abstract and any text in the drawings need translating. The translation is due within the 31 months; the period can be extended by 2 months on written request, against a fee — useful as a safety net, but not something to plan around. We handle translation as part of the filing and quote it up front rather than itemising it separately after the fact.
Official fees
Ukrainian patent fees are set in hryvnia. The figures below are those published in the WIPO PCT Applicant’s Guide for Ukraine, current from 1 January 2026:
| Item | Fee |
|---|---|
| Filing fee (online filing) | UAH 1,280 |
| — each 50 sheets over 150 | + UAH 640 |
| — each claim over three | + UAH 160 |
| Examination fee | UAH 6,000 |
| — each independent claim over one | + UAH 6,000 |
| Publication of the grant | UAH 400, plus UAH 20 per page over 15 |
| Grant fee | USD 100 equivalent |
Paper filing costs more (UAH 1,600 base). The filing, examination and publication fees are reduced by 90% where all applicants are the inventors, and by 80% where all applicants are non-profit organisations; the grant fee is not reduced. Maintenance (annuity) fees fall due separately after grant.
The structure matters for quoting: the expensive line is the examination fee, and it scales with independent claims, not total claims. Restructuring a claim set with several independent claims before entry can change the official cost noticeably.
Professional fees are fixed per matter and agreed before work starts. For qualified firms, payment after filing is available — we file first and invoice once the application is confirmed on record with UANIPIO.
After filing
Office actions during examination are reported with our analysis and a recommended response, priced before the work is done — not billed as an open-ended hourly exercise.
What actually goes wrong
In practice, the things that create real problems are rarely the headline deadline itself — firms generally know the 31-month date. The more common issues are:
- Counting from the international filing date instead of the earliest priority date, when the two differ
- Carrying a claim set with several independent claims into the national phase without realising each one adds a full examination fee
- Leaving translation until close to the deadline and relying on the 2-month extension instead of treating it as a fallback
Sending us a matter
Send the PCT number and the priority date, and we will confirm the actual deadline, a fixed quote and a filing timetable within one working day. See PCT National Phase Entry for the full process, or get in touch directly.
